A HIV positive woman who threatened a neighbour with a hypodermic needle has been jailed.

Jane Hart, 44, of Wakefield Road, Athersley, was involved in an altercation with Kerry Fisher, who was having a party in her garden, on May 28.

Chantel Lowery-Green, prosecuting, said children at the party were feeding Hart’s dog through the fence which had agitated her.

“This made her angry and she confronted Miss Fisher, who says she was threatened with a needle,” Mrs Lowery-Green said. “Given the fence’s height, which was only about three feet tall, and the offender being HIV positive, she felt the stabbing threat was real and alerted the police.”

Hart, who appeared via video link at Barnsley Magistrates’ Court on Monday, pleaded guilty to threatening behaviour with intent and was given a 12-week custodial sentence and ordered to pay £50 in compensation.
